• www.auzaro.com does not make any representation or Warranty as to specifics (such as quality, value, salability, etc) of the products or services proposed to be sold or offered to be sold or purchased on the Website.
• www.auzaro.com does not implicitly or explicitly support or endorse the sale or purchase of any products or services on the Website.
• www.auzaro.comaccepts no liability for any errors or omissions, whether on behalf of itself or third parties.
• www.auzaro.com is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers.

• The Website is only a platform that can be utilized by Users to reach a larger base to buy and sell products or services. www.auzaro.com is only providing a platform for communication and it is agreed that the contract for sale of any of the products or services shall be a strictly bipartite contract between the Seller and the Buyer.
• At no time shall www.auzaro.com hold any any right, title or interest over the products nor shall www.auzaro.com have any obligations or liabilities in respect of such contract.
• www.auzaro.com is not responsible for unsatisfactory or delayed performance of services or damages or delays as a result of products which are out of stock, unavailable or back ordered.
• You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance etc. with the seller(s) that You transact with.
    Disclaimer: Pricing on any product(s) as is reflected on the Website may due to some technical issue, typographical error or product information published by seller may be incorrectly reflected and in such an event seller may cancel such your order(s).

• The www.auzaro.com, being the contracting entity that you are contracting with is Aanya E-Commerce Private Limited (Company registration details/ provide link to details) if you are a registered member of the Site and registered or resident in India.  As some or part of the Services may be supported and provided by affiliates of www.auzaro.com, may delegate some of the Services to its affiliates, who you agree may invoice you for their part of the Services.
• You must register as a member on the Site in order to access and use some Services. Further, www.auzaro.com reserves the right, without prior notice, to restrict access to or use of certain Services (or any features within the Services) to paying Users or subject to other conditions that www.auzaro.com may impose in our discretion. 
  If you use the Website, You shall be responsible for maintaining the confidentiality of your Display Name and Password and you shall be responsible for all activities that occur under your Display Name and Password. • By posting or displaying any information, content or material (hereinafter referred to as the ‘User Content’) on the Site or providing any User Content to www.auzaro.com or our representative(s), you grant an irrevocable, perpetual, worldwide, royalty-free, and sub-licensable (through multiple tiers) license to www.auzaro.com to display, transmit, distribute, reproduce, publish, duplicate, adapt, modify, translate, create derivative works, and otherwise use any or all of the User Content in any form, media, or technology now known or not currently known in any manner and for any purpose which may be beneficial to the operation of the Site, the provision of any Services and/or the business of the User. Member Accounts

• User must be registered on the Site to access or use some Services (a registered User is also referred to as a ‘Member’. In case of companies the definition of member is the company not the contact person.). Except with www.auzaro.com’s approval, one User may only register one member account on the Site. www.auzaro.com may cancel or terminate a User’s member account if www.auzaro.com so deems fit and has reasons to suspect that the User has concurrently registered or controlled two or more member accounts. Further, www.auzaro.com may reject User’s application for registration for any reason and reserves such right.
• Upon registration on the Site, www.auzaro.com shall assign an account and issue a member ID and password (the latter shall be chosen by a registered User during registration) to each registered User. An account may have a web-based email account with limited storage space for the Member to send or receive emails intimating information required from the Site/ its affiliates.
• A set of Member ID and password is unique to a single account. Each Member shall be solely responsible for maintaining the confidentiality and security of your Member ID and password and for all activities that occur under your account. No Member may share, assign, or permit the use of your Member account, ID or password by another person outside of the Member’s own business entity. Member agrees to notify www.auzaro.comimmediately if you become aware of any unauthorized use of your password or your account or any other breach of security of your account.
• Member agrees that all activities that occur under your account (including without limitation, posting any company or product information, clicking to accept any Additional Agreements or rules, subscribing to or making any payment for any services, sending emails using the email account or sending SMS) will be deemed to have been authorized by the Member.
• Member acknowledges that sharing of your account with other persons, or allowing multiple users outside of your business entity to use your account (hereinafter collectively referred to as ‘multiple use’), may cause irreparable harm towww.auzaro.com or other Users of the Sites. Member shall indemnify www.auzaro.com, our affiliates, directors, employees, agents and representatives against any loss or damages (including but not limited to loss of profits) suffered as a result of the multiple use of your account. Member also agrees that in case of the multiple use of your account or Member’s failure to maintain the security of your account, www.auzaro.comshall not be liable for any loss or damages arising from such a breach and shall have the right to suspend or terminate Member’s account without liability to Member.

Member’s Responsibilities

• Each Member represents, warrants and agrees that:
  • you have full power and authority to accept the Terms, to grant the license and authorization and to perform the obligations hereunder;
  • you use the Sites and Services for business purposes only; and
  • the address you provide when registering is the principal place of business of your business entity.  For purposes of this provision, a branch or liaison office will not be considered a separate entity and your principal place of business will be deemed to be that of your head office.
• Member will be required to provide information or material about your entity, business or products/services as part of the registration process on the Sites or your use of any Service or the member account.  Each Member represents, warrants and agrees that:

  • not violate any applicable laws and regulations (including without limitation those governing export control, consumer protection, unfair competition, or false advertising) or promote any activities which may violate any applicable laws and regulations;
  • not contain any link directly or indirectly to any other web Sites which includes any content that may violate the Terms.
• Each Member further represents, warrants and agrees that you shall:
  • Carry on your activities on the Site in compliance with any applicable laws and regulations;
  • conduct your business transactions with other users of the Site in good faith;
  • carry on your activities in accordance with the Terms and any applicable Additional Agreements;
  • not use the Services or Site to defraud any person or entity (including, but not limited to, sale of stolen items, use of stolen credit/debit cards);
  • not impersonate any person or entity, misrepresent yourself or your affiliation with any person or entity;
  • not engage in spamming or phishing;
  • not engage in any other unlawful activities (including, but not limited to, those which would constitute a criminal offence, give rise to civil liability,  etc) or encourage or abet any unlawful activities;

  • not involve any computer viruses or other destructive devices and codes that have the effect of damaging, interfering with, intercepting or expropriating any software or hardware system, data or personal information;
  • not involve any scheme to undermine the integrity of the data, systems or networks used by www.auzaro.comand/or any user of the Sites or gain unauthorized access to such data, systems or networks;
  • not engage in any activities that would otherwise create any liability forwww.auzaro.comor our affiliates.
• Member may not use the Services and member account to engage in activities which are identical or similar to www.auzaro.com’s e-commerce marketplace business.
• If Member provides a business referee, Member represents, warrants and agrees that you have obtained all necessary consents, approvals and waivers from your business partners and associates to (a) act as your business referee; (b) post and publish their contact details and information, reference letters and comments on their behalf; and (c) that third parties may contact such business referees to support claims or statements made about you. You further warrant and agree that all reference letters and comments are true and accurate and third parties may contact the business referees without the need to obtain your consent.
• Member agrees to provide all necessary information, materials and approval, and render all reasonable assistance and cooperation necessary for www.auzaro.com’s provision of the Services, evaluating whether Member has breached the Terms and/or handling any complaint against the Member.  If Member’s failure to do so results in delay in, or suspension or termination of, the provision of any Service,www.auzaro.comshall not be obliged to extend the relevant service period nor shall be liable for any loss or damages arising from such delay, suspension or termination.
• Member acknowledges and agrees that www.auzaro.com shall not be required to actively monitor nor exercise any editorial control whatsoever over the content of any message or material or information created, obtained or accessible through the Services or Site. www.auzaro.com does not endorse, verify or otherwise certify the contents of any comments or other material or information made by any Member. Each Member is solely responsible for the contents of their communications and may be held legally liable or accountable for the content of their comments or other material or information
• Member acknowledges and agrees that the Services may only be used by businesses and their representatives for business use and not for individual consumers or for personal use.
• Member acknowledges and agrees that each Member is solely responsible for observing applicable laws and regulations in its respective jurisdictions to ensure that all use of the Site and Services are in compliance with the same.

6. Breaches by Members

• If any Member breaches any Terms or if www.auzaro.com has reasonable grounds to believe that any Member is in breach of any the Terms, www.auzaro.com shall have the right to impose a penalty against the Member, or suspend or terminate the Member’s account or subscription of any Service without any liability to the Member.   www.auzaro.com shall also have the right to restrict, refuse or ban any and all current or future use of any other Service that may be provided by www.auzaro.com.  The penalties that www.auzaro.com may impose include, among others, warning, removing any product listing or other User Content that the Member has submitted, posted or displayed, imposing restrictions on the number of product listings that the Member may post or display, or imposing restrictions on the Member’s use of any features or functions of any Service for such period as www.auzaro.com may consider appropriate in our sole discretion.
• Without limiting to the generality of the provisions of the Terms, a Member would be considered as being in breach of the Terms in any of the following circumstances:
  • upon complaint or claim from any third party, www.auzaro.com has reasonable grounds to believe that such Member has willfully or materially failed to perform your contract with such third party including without limitation where the Member has failed to deliver any items ordered by such third party after receipt of the purchase price, or where the items Member has delivered materially fail to meet the terms and descriptions outlined in your contract with such third party,
  • www.auzaro.com has reasonable grounds to suspect that such Member has used a stolen credit card or other false or misleading information in any transaction with a counter party,
  • www.auzaro.com has reasonable grounds to suspect that any information provided by the Member is not current or complete or is untrue, inaccurate, or misleading, or
  • www.auzaro.com believes that the Member’s actions may cause financial loss or legal liability to www.auzaro.com or our affiliates or any other Users.
• www.auzaro.com reserves the right to cooperate fully with governmental authorities, private investigators and/or injured third parties in the investigation of any suspected criminal or civil wrongdoing.  Further, www.auzaro.com may disclose the Member's identity and contact information, if requested by a government or law enforcement body, an injured third party, or as a result of a subpoena or other legal action. www.auzaro.com shall not be liable for damages or results arising from such disclosure, and Member agrees not to bring any action or claim againstwww.auzaro.com for such disclosure.
• If a Member is in breach of the Terms, www.auzaro.com also reserves the right to publish the records of such breach on the Sites.  If such breach involves or is reasonably suspected of involving dishonest or fraudulent activities, www.auzaro.comalso reserves the right to disclose the records of such breach to our affiliates. Suchwww.auzaro.com affiliates may impose limitation on, suspend or terminate the Member’s use of all or part of the services provided by such affiliates to the Member, take other remedial actions, and publish the records about the Member’s breach of the Terms on the websites operated by or controlled by such www.auzaro.com affiliates.
• www.auzaro.com may, at any time and in our reasonable discretion, impose limitations on, suspend or terminate the Member’s use of any Service or the Site without being liable to the Member if www.auzaro.com has received notice that the Member is in breach of any agreement or undertaking with any affiliate of www.auzaro.com and such breach involves or is reasonably suspected of involving dishonest or fraudulent activities.  www.auzaro.com shall have the right to publish the records of such breach on the Site.  www.auzaro.com shall not be required to investigate such breach or request confirmation from the Member.
• Each Member agrees to indemnify www.auzaro.com, our affiliates, directors, employees, agents and representatives and to hold them harmless, from any and all damages, losses, claims and liabilities (including legal costs on a full indemnity basis) which may arise from your submission, posting or display of any User Content, from your use of the Sites or Services, or from your breach of the Terms.

• The listing description of the item must not be misleading and must describe actual condition of the product. 8. Transactions Between Buyers and Sellers

• Through the Site, www.auzaro.com provides electronic web-based platforms for exchanging information between buyers and sellers of products and services.   www.auzaro.com additionally provides electronic web-based transaction platforms for Members to place, accept, conclude, manage and fulfill orders for the provision of products and services online within the Site subject to the terms of the www.auzaro.com’s Transaction Services Agreement.  However, for any Services,www.auzaro.com does not represent either the seller or the buyer in specific transactions. www.auzaro.com does not control and is not liable to or responsible for the quality, safety, lawfulness or availability of the products or services offered for sale on the Sites or the ability of the sellers to complete a sale or the ability of buyers to complete a purchase.
• Users are hereby made aware that there may be risks of dealing with people acting under false pretences. www.auzaro.com uses several techniques to verify the accuracy of certain information our paying Users provide us when they register for a paying membership service on the Site.  However, because user verification on the Internet is difficult, www.auzaro.com cannot and does not confirm each User's purported identity (including, without limitation, paying Members). We encourage you to use various means, as well as common sense, to evaluate with whom you are dealing.
• Each User acknowledges that it is fully assuming the risks of conducting any purchase and sale transactions in connection with using the Site or Services, and that it is fully assuming the risks of liability or harm of any kind in connection with subsequent activity of any kind relating to products or services that are the subject of transactions using the Site. • In the event that any User has a dispute with any party to a transaction, such User agrees to release and indemnify www.auzaro.com (and our agents, affiliates, directors, officers and employees) from all claims, demands, actions, proceedings, costs, expenses and damages (including without limitation any actual, special, incidental or consequential damages) arising out of or in connection with such transaction.

9. Payments between Buyers and Sellers

• You, as a Buyer, understand that upon initiating a Transaction You are entering into a legally binding and enforceable contract with the Seller to purchase the products and /or services from the Seller using the Payment Facility, and You shall pay the Transaction Price through Your Issuing Bank to the Seller using Payment Facility.
• You, as a Buyer, may agree with the Seller through electronic communication and electronic records and using the automated features as may be provided by Payment Facility on any extension / increase in the Dispatch and/or Delivery time and the Transaction shall stand amended to such extent. Any such extension / increase of Dispatch / Delivery time or subsequent notation / variation of the Transaction should be in compliance with Payment Facility Rules and Policies.
• You, as a Buyer, shall electronically notify auzaro.com using the appropriate mode onwww.auzaro.com Website features upon Delivery or non Delivery within the time period as provided in Policies. Non notification by You of Delivery or non Delivery within the time period specified in the Policies shall be construed as a deemed Delivery in respect of that Transaction. In case of Cash On Delivery transactions, Buyer is not required to confirm the receipt of products or services.
• You, as a Buyer, shall be entitled to claim a refund of the Transaction Price (as Your sole and exclusive remedy) in case You do not receive the Delivery within the time period agreed in the Transaction or within the time period as provided in the Policies, subject to force majeure clause whichever is earlier. In case you do not raise a refund claim using Website features within the stipulated time than this would make, You ineligible for a refund unless approved later by the seller.
• You, as a Buyer, understand that the Payment Facility may not be available in full or in part for certain category of products and/or services and/or Transactions as mentioned in the Policies and hence You may not be entitled to a refund in respect of the Transactions for those products and /or services
• Except for Cash On Delivery transaction, refund, if any, shall be made at the same Issuing Bank from where Transaction Price was received.
• For Cash On Delivery transactions, refunds, if any, will be made via NEFT/RTGS to the buyers bank account favour of the Buyer (As per registration details provided by the Buyer) or in store credit as chosen by the buyer at the time of return.
• Refund shall be made in Indian Rupees only and shall be equivalent to the Transaction Price received in Indian Rupees.
• For electronics payments, refund shall be made through payment facility using NEFT / RTGS or any other online banking / electronic funds transfer system approved by Reserve Bank India (RBI).
• Refund shall be conditional and shall be with recourse available to www.auzaro.com in case of any misuse by Buyer.
• Refund shall be subject to Buyer complying with Policies.
• www.auzaro.com reserves the right to impose limits on the number of Transactions or Transaction Price which www.auzaro.com may receive from on an individual Valid Credit/Debit/ Cash Card / Valid Bank Account/ and such other infrastructure or any other financial instrument directly or indirectly through payment aggregator or through any such facility authorized by Reserve Bank of India to provide enabling support facility for collection and remittance of payment or by an individual Buyer during any time period, and reserves the right to refuse to process Transactions exceeding such limit.
• www.auzaro.com reserves the right to refuse to process Transactions by Buyers with a prior history of questionable charges including without limitation breach of any agreements by Buyer with.www.auzaro.com or breach/violation of any law or any charges imposed by Issuing Bank or breach of any policy.
• www.auzaro.com may do such checks as it deems fit before approving the receipt of/Buyers commitment to pay (for Cash On Delivery transactions) Transaction Price from the Buyer for security or other reasons at the discretion of www.auzaro.com. As a result of such check if www.auzaro.com is not satisfied with the creditability of the Buyer or genuineness of the Transaction / Transaction Price, it will have the right to reject the receipt of / Buyers commitment to pay Transaction Price.
• www.auzaro.com may delay notifying the payment confirmation i.e. informing Seller to Dispatch, if www.auzaro.com deems suspicious or for Buyers conducting high transaction volumes to ensure safety of the Transaction and Transaction Price. In addition, www.auzaro.com may hold Transaction Price and www.auzaro.com may not inform Seller to Dispatch or remit Transaction Price to law enforcement officials (instead of refunding the same to Buyer) at the request of law enforcement officials or in the event the Buyer is engaged in any form of illegal activity.
• The Buyer and Seller acknowledge that www.auzaro.com will not be liable for any damages, interests or claims etc. resulting from not processing a Transaction/Transaction Price or any delay in processing a Transaction/Transaction Price which is beyond control of www.auzaro.com.
• Compliance with Laws: Buyer and Seller shall comply with all the applicable laws (including without limitation Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Customs Act, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made there under, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, Export Import Policy of government of India) applicable to them respectively for using Payment Facility and www.auzaro.comWebsite.
• Buyer's arrangement with Issuing Bank: All Valid Credit / Debit/ Cash Card/ and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank and payment instrument issuing company.
• All Online Bank Transfers from Valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank which support Payment Facility to provide these services to the Users. All such Online Bank Transfers on Payment Facility are also governed by the terms and conditions agreed to between Buyer and the respective Issuing Bank.

10. Replacement Guarantee

The Replacement Guarantee seeks to assist Buyers who have been defrauded by qualified sellers on the Website. If at the time of delivery and/or within specified days from the date of delivery of the product/s, if any defect is found, then the buyer of the product/s can ask for replacement of the product/s from the seller.

10 Day Replacement Guarantee

The 10 Day Replacement Guarantee seeks to assist Buyers who have been defrauded by qualified sellers on the Website. If at the time of delivery and/or within 10 days from the date of delivery of the product/s, if any defect is found, then the buyer of the product/s can ask for replacement of the product/s from the seller subject to the following terms and conditions:

• Notify seller of any defects in the product/s at the time of delivery of the product/s and/or within 10 days from the date of delivery and the same product/s will be replaced in return of the defective product/s.
• Replacement can be for the entire product/s or part/s of the product subject to availability of the same with the seller.

Following products shall not be eligible for return or replacement:

11. Returns Policy

• Definition: 'Return' is defined as the action of giving back the item purchased by the Buyer to the Seller on the website.
• Following situations may arise:
  • Item was defective/not working.
  • Item was damaged during the Shipping process.
  • Products was / were missing in the box received.
  • Wrong item was sent by the Seller.

Return could also result in refund of money in most of the cases or as per the return policy of the seller.

Points to be noted:

• Seller can always accept the return irrespective of the policy.
• If Seller disagrees a return request, Buyer can file a dispute under the Buyer Protection Program applicable at the time of ordering.
• We encourage the Buyer to review the listing before making the purchase decision. In case Buyer orders a wrong item, Buyer shall not be entitled to any return/refund.
• Buyer need to raise the refund request within 10 days from the date of payment realization. Once Buyer has raised a return request by contacting Us on +91 9022990071/ logistics@auzaro.com, Seller while closing the return ticket can select one of the following:
  • Replace after shipment collection - Seller has agreed to wait for the logistics team to collect the shipment from the buyer before replacing it
  • Refund after shipment collection - Seller has agreed to wait for the logistics team to collect the shipment from the buyer before refunding
  • Refund without shipment collection - Seller has agreed to refund the buyer without expecting the original shipment back
  • Replace without shipment collection - Seller has agreed to replace the order without expecting the original shipment back
  • On certain select days as specified by the Website, separate policies may be applicable.
• In the event the Seller accepts the return request raised by the Buyer, Buyer will have to return the product and then the refund shall be credited to the Buyers account depending on the mode of original payment and as per our "Returns & Cancellation Policy"
